Welcome to basn5. basn5 is operated by Tajima Direct LLC, doing business as basn5 (“basn5,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) govern your access to and use of our website and your purchase of our products. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) to place an order. By using the site you represent that you meet this requirement and that any information you provide is accurate.
2. Prescriptions
If you order prescription lenses, you represent and warrant that:
- You have a valid, unexpired eyeglass prescription issued by a licensed eye care professional, and the values you enter or upload match it exactly;
- The prescription is yours (or you are authorized to order on behalf of the person it belongs to); and
- You will review your order confirmation and tell us promptly if anything is wrong.
We manufacture lenses to the prescription as you submit it. We are not an eye care provider, we do not verify prescriptions with your doctor unless required by law, and nothing on the site is medical advice. Glasses are not a substitute for regular eye exams. If a measurement such as pupillary distance (PD) or segment height is self-reported or estimated, small variations in comfort can result; our home try-on exists in part to help you get these right.
3. Home try-on
For prescription orders we offer an optional home try-on: we ship your frames fitted with non-prescription lenses along with a prepaid return label, so you can confirm fit before your prescription lenses are made. When you send the frames back, we make and install your prescription lenses and return the finished glasses to you. If you decide not to proceed after the try-on, we will refund your order minus a $30 per pair restocking fee, as described in our Return & Warranty Policy. Try-on frames remain subject to these Terms; please return them in the condition received.
4. Orders and payment
All prices are in U.S. dollars unless otherwise shown. By placing an order you authorize us (and our payment processors) to charge your selected payment method for the total shown at checkout, including any shipping and taxes. We may refuse, limit, or cancel any order — including after confirmation — for reasons such as suspected fraud, pricing or listing errors, or stock issues; if we cancel a paid order, we will refund it in full. Occasionally a product description, image, or price may contain an error; we make reasonable efforts to keep the site accurate but do not guarantee it is error-free.
All purchases of physical items are made pursuant to a shipment contract: risk of loss and title pass to you upon our delivery of the item to the carrier. That said, if a package goes missing or arrives damaged, contact us — we will work with you and the carrier to make it right, as described in our Shipping Policy. Optional shipping insurance is available at checkout; insured shipments that are lost, stolen, or damaged in transit are reshipped or refunded per the Shipping Policy.
5. Returns and warranty
Returns, refunds, the $30 per pair restocking fee, the non-refundability of custom prescription lenses, and our one-year warranty against manufacturer defects are governed by our Return & Warranty Policy, which is part of these Terms.
6. Accounts
If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorized use. We may suspend or close accounts at our discretion, including for violations of these Terms.
7. Intellectual property
All content on the site — including text, images, photography, product designs, logos, trademarks, page layouts, and software — is owned by or licensed to us and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes. You may not reproduce, distribute, modify, scrape, or commercially exploit any content without our prior written permission. “basn5” and our logos may not be used without our consent.
8. Prohibited uses
You agree not to: use the site for any unlawful purpose; attempt to gain unauthorized access to the site or its systems; interfere with the site’s operation or security; submit false or fraudulent information (including prescriptions or payment details); harvest data about other users; upload malicious code; or use the site to compete with us or to build a competing product or dataset.
9. Submissions
If you send us ideas, suggestions, reviews, photos, or other materials (other than your personal and prescription information, which is governed by our Privacy Policy), you grant us a perpetual, royalty-free license to use them without restriction or compensation, and you represent that you have the right to share them.
10. Third-party links and services
The site may link to or rely on third-party websites and services (for example, payment providers and shipping carriers). We do not control and are not responsible for third-party content, policies, or practices. Your use of them is at your own risk and subject to their terms.
11. Disclaimer of warranties
EXCEPT FOR THE EXPRESS ONE-YEAR WARRANTY IN OUR RETURN & WARRANTY POLICY, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BASN5, TAJIMA DIRECT LLC, OR THEIR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
13. Indemnification
You agree to indemnify and hold harmless basn5 and Tajima Direct LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of law, or your submission of inaccurate prescription or order information.
14. Governing law
These Terms and any dispute arising out of them or your use of the site are governed by the laws of the State of California, without regard to its conflict-of-law principles.
15. Dispute resolution
If you have a problem, contact us first at help@basn5.com — most issues can be resolved quickly and informally. For any dispute that cannot be resolved informally within 30 days of written notice, you and we agree that the dispute will be resolved by binding arbitration on an individual basis, administered in California under the rules of a recognized arbitration provider, rather than in court. Either party may instead bring an individual claim in small-claims court. YOU AND WE EACH WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. If this arbitration agreement is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California.
16. Changes; severability; entire agreement
We may update these Terms from time to time; the version posted on the site at the time of your order applies to that order. If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, Return & Warranty Policy, and Shipping Policy, are the entire agreement between you and us regarding the site and your purchases.
